Appeal Court orders retrial of 6 electoral cases in Imo

The political tension generated during the last general election in Imo State is far from over, as the Court of Appeal sitting in Owerri has ordered retrial of no fewer than six electoral cases already decided by the Election Petition Tribunal also sitting in Owerri.
The election petition cases ordered for retrial include the Chief Achike Udenwa versus Senator Hope Uzodinma senatorial matter and Chikwem Onuoha versus Matthew Omegara contest for the Okigwe North federal constituency.
Other matters involving state constituency seats that were similarly ordered for retrial are the Obinna Ambrose Egu/Chukwuemeka Nwafor (Ngor Okpala), Celestine Ngobiwu/John Kekeocha (Obowo), Chief Samuel Anyanwu/Kyrian Anyachokeya Okorie (Ikeduru), as well as Josephat Emenaha versus Action Congress of Nigeria’s Mr. Chino (Njaba).
Handing down judgment in the Udenwa/Uzodinma case, the Appeal Court presided over by Hon. Justices Uwani Abaji, Chedi Uwa, Hanena Ismani, upheld Udenwa’s appeal against the decision of the Election Petitions Tribunal.
However, the appeal filed by Chief Chukwudi Mayor Eze of Action Congress of Nigeria against the election Chief Jerry Alagbaoso of the Peoples Democratic Party, was thrown out.
Alagbaoso’s team of lawyers had argued that Eze’s application did not comply with the Electoral Act and after examining the evidence and submissions of councel on both sides, the Court upheld the July 7, 2011 decision of the Election Tribunal.
